1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Aixora Tech ("we," "us," or "our"), concerning your access to and use of our website as well as any other media form, linked pages, or application related, linked, or otherwise connected thereto. By using our Services, you agree to these Terms.

Unless otherwise indicated, the Site and Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

Custom software and applications developed for clients generally belong to the client upon final payment, subject to separate software development agreements.

3. Communication Services Guidelines

If you utilize our Bulk WhatsApp Messaging or OBD Voice Call Services, you agree to adhere to the following strict guidelines:

• Consent: You confirm that you have explicit, opt-in consent from individuals to send them WhatsApp messages or OBD calls.
• No Spam: You will not use our platforms to distribute unsolicited promotional content, spam, or misleading messages.
• Content Restrictions: You shall not transmit any content that is illegal, abusive, harassing, defamatory, fraudulent, or otherwise objectionable.
• Compliance: For political campaigns, you are responsible for complying with all local election commission regulations, telecom guidelines (e.g., TRAI in India), and WhatsApp Commerce/Business policies.

4. Delivery & Payment Terms

For software, application, and web development services, project scope, timelines, and payment terms will be defined in a specific Statement of Work (SOW). For our communication APIs and bulk messaging services, payment is typically pre-paid based on credits or quota packages.

5. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services.

6. Account Suspension

We reserve the right to suspend or terminate your account and access to our platform (especially for WhatsApp or Voice Call dashboards) without notice if we detect a breach of these Terms, particularly regarding spamming or non-compliant messaging behavior.
